Mr. Domenici is a graduate of the University of New Mexico Law School and a member of the New Mexico Bar. He has been practicing law since 1986. Mr. Domenici has been in Best Lawyers in America in Environmental Law since 1994 and is listed as a Super Lawyer in Environmental Law and as one of the top 25 lawyers in New Mexico. Mr. Domenici works extensively in all phases of environmental and natural resources law, western law, professional malpractice defense and general civil practice.
Mr. Domenici represents numerous clients in litigation related to environmental and natural resources issues. Mr. Domenici has an extensive background in environmental matters including all aspects of facility permitting with the New Mexico Environment Department, the United States Environmental Protection Agency, local land use bodies, and other state agencies. He has participated in administrative hearings and presented evidence for clients before those proceedings. He is a key participant in RCRA permitting for industry in front of the New Mexico Environment Department.
Mr. Domenici has experience in general litigation of tort, commercial, real estate, professional malpractice defense, insurance coverage, and related issues. He practices in all state courts in New Mexico. He has tried numerous civil jury and non-jury trials. He has represented clients in the sale and establishment of property rights appurtenant to land grant lands. Mr. Domenici participated in extensive efforts to establish water and wastewater utilities for Bernalillo County and worked extensively with small water associations in establishing water and wastewater systems and in the managing their business affairs.
Mr. Domenici has extensive experience in transactions involving businesses, ranches, dairies and other real estate and rural properties. He also provides representation on matters involving non-liquid assets such as land, permits/licenses, resources and other types of property. Mr. Domenici has experience in land conservations easements and tax credits. Mr. Domenici supplied expertise for contracts and work related to research, development drafting, and presentation of theories and claims regarding Western/Southwestern/New Mexico water rights.
Mr. Domenici has worked extensively with disadvantaged clients and traditional communities’ members on water rights issues and personal liberty issues. He represented states and local governmental entities and quasi-government entities on water resources and environmental issues.
Mr. Domenici has represented a number of governmental entities, including the WIPP RCRA permit Permittees, the Village of Los Lunas on issues involving surface water discharge, Village of Questa in relation to environmental and natural resource issues involving the Questa mine, the City of Alamogordo, the City of Carlsbad, and Los Alamos National Laboratory. In all of these matters, Mr. Domenici is familiar with reporting to government entities, developing and fulfilling long-term deliverable requirements, and providing acceptable deliverables to clients.
